Open letter to Pranab Mukherjee, Hon'ble President of India

Hon'ble Sir,

We, the undersigned office bearers of the All Tribal Students' Union Manipur (ATSUM) on behalf of the Scheduled Tribe community, have the honour to submit our humble representation for favour of your kind intervention.
Non implementation of Constitutional laws: The Tribals of Manipur under the aegis of the All Tribal Students' Union Manipur has been consistently pressurising the Central Government for securing proper functioning of the Hill Areas Committee (HAC) as all scheduled matters in so far as they relate to the areas is within the purview of the HAC under Article 371C of the HAC. Whereas, the three anti-tribal bills were introduced on the floor of the Manipur Legislative Assembly on 31st August, 2015 without referring to the HAC for consideration as envisaged under Article 371C.

That, the three Bills being unconstitutional and a gross violation of the rules and procedures and conduct of business, giving assent for approval will be tantamount to annihilating the ideals of democracy.

The Central Educational Institutions (Reservation in Admissions) Amendment Act 2012 under Ministry of Law and Justice (Legislative Department) Section II (1a) stipulates that reservation norms in Central Educational Institutions in the tribal inhabited states of Northeast India including Manipur be as per State Govt norms, Manipur University has been implementing for the academic session 2014-2015 as per the verdict on PIL No. 18 of 2014. Whereas, in reverse, the Deans' Committee on April 4, 2016 has adopted a resolution vide Res No. 2 clause (a) and (b) for revocation of Reservation policy in Manipur University in contravention to the existing Act of Parliament to further discriminate and marginalize the tribal community in Manipur.

That, reservation for ST as per Central Government norms on percentage of Reservation is 34% for Manipur vide DOP & T Office M.O. NO. 36011/6/2010-EStt(Res) issued by Department of Personnel, P.G & Pensions, Dated 25th June, 2010 is not maintained in respect of direct recruitment to group "C" and "D" posts in Central Universities viz, Manipur University, Regional Institute of Medical Sciences, Central Agriculture University and other central funded institutions. In order to usher in all round development of the hills, separate State Commission for ST under Article 338-A of the constitution is the need of the hour. To this end, ATSUM has been pressurising the GOM for early setting up of ST Commission since 2012. But till today, it is yet to be materialised.
We, therefore beseech your Hon'ble self being the constitutional head of India to kindly address the above cited subjects so as to safeguard the sanctity of the Constitution.
