This Resolution has been passed due to proposed of Public Hearing in connection with Oil Exploration in the remote areas of of Churachandpur District, Manipur, North East India by the Manipur Pollution Control Board to be held at Sibapukhrikhal Community Hall, Sibapukrikhal, Tipaimukh Sub-Division, Churachandpur District on 21st November 2012.
RESOLUTION
The gathering of Hmar Student Association (HSA) GHQ, Zomi Students’ Federation (ZSF), GHQ, Sinlung Indigenous Peoples Human Rights Organisation (SIPHRO), Zomi Economic Planning and Development Agency (ZEPADA), Zomi Mothers’ Association (ZMA) GHQ, Churachandpur District Students’ Union (CDSU), Zomi Human Rights Foundation (ZHRF), and Intellectuals on the twentieth day of October, Two Thousand and Twelve at Hmar Students Association, GHQ, Rengkai, Lamka, Manipur have a detail deliberation on the proposed Oil Exploration to be conducted by Jubilant Oil and Natural Gas Private Limited in Churachandpur District without obtaining the free, prior and informed consent and without the active participation in the decision making of the Indigenous Peoples :‐
AND unanimously CONCLUDED that,
the discreet agreement concluded between the Jubilant Oil and Natural Resources Private Limited and the Ministry of Forest and Environment, Government of India is unacceptable to the Indigenous Peoples.
The gathering condemns the State Government for granting a permission to the M/s Jubilant Oil and Natural Resources Pvt Ltd to conduct survey within an area of 4000 square kilometers which includes the Tipaimukh Project area for the exploration work without any consultation of the Hill Areas Committee (HAC).
Both the Governments and Jubilant Oil and Natural Resources Private Ltd are indicted for undermining, abusing the Manipur Hills Regulation Act, 1947, Indian Constitution Article 371 (C ) which protects, promote the existing traditional tribal Chieftainship institution and tribal right over
land.
AND therefore unanimously DECIDED to object and opposed, in toto,
the Public Hearing organized by Manipur Control Pollution Board which is to be held at Sibapukhrikhal Community Hall, Sibapukrikhal, Tipaimukh Sub-Division, Churachandpur District on 21th November 2012 as the activities of oil exploration and extraction would affect adversely the cultures, traditional livelihood, socio-political fabrics and the flora and fauna of the region.
AND unanimously RESOLVED that,
(i) the Government should provide a Constitutional Protection and safeguard to Tribal land, culture, customs, values and traditional institutions such as Chieftainship.
(ii) the Government should protect and promote the United Nations on the Rights to Development which state that “the right to development is an inalienable human rights by virtue of which every human person and all peoples are entitled to participate in, contribute to, and enjoy economic, social, cultural and political development, in which all human rights and fundamental freedoms can be fully realized.
(iii) the Government should protect the International Labor Organization 107 Article 11 which read “the right of ownership, collective or individual, of the members of the populations concerned over the lands which these populations traditionally occupy shall be recognized and extend to ratifying of ILO 169.
(iv) Both the Governments and Jubilant Oil and Natural Resources Private Ltd has to be conscious about that complicity is always accountable for Gross Human Rights Violation (v) Governments should promote and defend Universal Declaration on Human Rights (UDHR) and Vienna Conference Declaration, 1993 where it is the largest democratic set up around the world.
